Terms & Conditions
Due to constantly fluctuating material prices, any prices given on any estimates received will be valid for 7 days from the date shown on the estimate, after which time a new estimate may need to be drafted at Boylectrical’s discretion. Any unforeseen labour/material costs not originally allowed for may be incurred if significant additional works or materials become necessary as works are carried out. If applicable, these will be discussed with the customer before the works continue and the customer has the right to decline the additional works and/or materials. If work cannot continue without the additional works/materials then the installation will be made safe and a new invoice will be issued for the materials used and works carried out, plus 10% of the remaining balance, unless cancelled within the 14 day ‘cooling off period’. Please refer to the section explaining this below.
Once the customer has received their estimate(s) and would like to accept, they must notify Boylectrical with a written statement of their acceptance (unless verbal or another form of confirmation has been otherwise agreed at Boylectrical’s discretion). Email correspondence is preferred, however written confirmation can also be in the form of a written letter or a signed and returned estimate. If the customer requests a start date within the 14-day cancellation period, then they willingly enter into a ‘start work now’ agreement. Once confirmation has been received, the customer will then be entered into a contract with Boylectrical where they will be responsible for payment in full following the completion of the works. The required materials will then be ordered and a date convenient for both parties will be arranged for Boylectrical to come and complete the works. The preferred payment method is via bank transfer, although cash or card payments are also accepted. There may be an additional surcharge for larger cash or card payments to cover banking fees. For works requiring a substantial amount of materials, or special materials to be ordered in, a deposit may be required at Boylectrical’s discretion before the works are carried out. Delayed payments after completion of the works can be damaging to small businesses and so may incur an additional surcharge if not paid within a reasonable amount of time. If this is the case, an additional invoice will be sent out with the revised total due which will supersede the original invoice. Certification (and notification to building control where applicable) will be issued for the work completed only upon receipt of the payment due in full. This will be in the form of a PDF via email unless printed copies are requested.
Upon receipt of the payment in full, a warranty period of 1 year from the date shown on the invoice will come into effect covering all materials supplied and works carried out, unless otherwise stated. This 1 year period also covers any callout charges that would normally be incurred to return and replace any faulty materials. After this initial 1 year period, any items still within the manufacturer’s warranty or extended warranty may still be covered, but a callout charge would be incurred to return and replace any faulty materials.
The customer has the right to cancel their contract within the 14 day ‘cooling off period’. For more information, you could visit www.citizensadvice.org.uk/consumer/changed-your-mind/cancelling-a-service-youve-arranged. This ‘cooling off period’ begins the day after Boylectrical receives confirmation that the estimate(s) had been accepted and the customer has agreed for work to go ahead. Cancellation should be made by filling in the online cancellation form available at www.boylectrical.co.uk/cancellation-form. Alternatively, the customer can write to Boylectrical including the cancellation date, their full name and address, contact details, reason for cancellation and the relevant estimate number. Providing that no works have been carried out upon receipt of the cancellation notice, the customer will receive a full refund of any deposits paid and will not receive an invoice for any scheduled works. Any deposits paid for non-standard materials that would incur charges to return will not be refunded, however the materials will be surrendered to the customer. The ‘start work now’ agreement allows work to begin within the 14-day cancellation period, if desired, without the customer losing their right to cancel prematurely by contracting the customer to only pay for works carried out and materials used if they choose to then cancel within the 14-day cancellation period after work has begun, but before the work is complete. Work may still be cancelled after the 14-day cancellation period but the customer will be required to pay a cancellation fee consisting of any non-standard materials ordered, any labour already carried out plus 10% of the remaining balance. Due to the nature of the work being carried out, any unfinished installations must be left in a safe condition, even if this means that the electrical supply is not reconnected or the new installations are disconnected from the electrical supply.
In the unlikely event that; due to injury, illness or otherwise, the works cannot and will not be completed by or made safe by Boylectrical once started, the customer is protected under the ‘Works in Progress Warranty’ offered by Boylectrical. This guarantees that another registered electrician can be contacted to make the installation safe at the earliest convenience and at the expense of Boylectrical.
Should the customer have a complaint they wish to make, for whatever reason, there is the facility in place to do so at www.boylectrical.co.uk/complaints-form. Alternatively, complaints can be addressed to the attention of Daniel Boylett, Boylectrical, 30 Basil Close, Haydon Wick, Swindon, SN2 2TT or emailed to dan@boylectrical.co.uk with the subject ‘Complaint’. A response will then be sent out within 48 hours of receiving the complaint. The customer also has the right to contact the NICEIC directly if they feel that after contacting Boylectrical their complaint has not been dealt with satisfactorily. Your personal data, obtained directly from you when quoting or provided during our initial contact, is securely stored under the new General Data Protection Regulation (GDPR) 2018 (replacing the Data Protection Act 1998) and is used solely for estimations and invoices where applicable, and kept on file for legal reasons only. This data will not at any time be used in any other way or passed onto any other party. Boylectrical does not use personal data for marketing reasons. At any time, you as a customer or a potential customer can request from Boylectrical any personal data that is stored about yourself. You may then choose for this data to be permanently deleted for any reason.
